By contacting Boulder Bound LLC ("Boulder Bound," "we," "our," or "us") to request services, accepting a written estimate, or permitting work to begin on your property, you ("Client," "you," or "your") agree to be bound by these Terms and Conditions.
These Terms apply to all services provided by Boulder Bound LLC, including excavation, retaining wall installation, pond and water feature construction, land clearing, site preparation, concrete work, stone paver installation, and any related backyard transformation services.
If you do not agree to these Terms, please do not request or proceed with services.
Boulder Bound LLC provides residential and commercial outdoor construction and excavation services in the northern Pittsburgh area and surrounding regions of Pennsylvania. Our services include, but are not limited to:
All work is subject to the specific scope outlined in a written estimate or contract. Boulder Bound LLC reserves the right to decline any project at its sole discretion.
All estimates are provided free of charge and are based on information available at the time of assessment. Estimates are valid for 30 days from the date of issue unless otherwise stated in writing.
An estimate is not a guarantee of final price. Final costs may vary due to:
Any material changes to the original estimate will be communicated to the Client in writing before additional work proceeds. Verbal agreements made on-site are not binding unless confirmed in writing.
Payment terms will be specified in your written estimate or contract. Standard payment terms are as follows unless otherwise agreed in writing:
Accepted payment methods include cash, check, and electronic transfer. Checks should be made payable to Boulder Bound LLC. Boulder Bound LLC reserves the right to charge a returned check fee of $35.00.
Accounts past due by more than 15 days may be subject to a 1.5% monthly finance charge. Boulder Bound LLC reserves the right to place a mechanic's lien on the property for unpaid balances in accordance with Pennsylvania law.
Note: All deposits are non-refundable once materials have been ordered or work has commenced, as these funds are used to secure scheduling and purchase project-specific materials.
Project scheduling is subject to availability, weather conditions, and crew capacity. Start dates are estimates and may shift due to weather delays, prior project overruns, or material availability.
The Client agrees to:
Boulder Bound LLC is not responsible for damage to unmarked private utilities. The Client is responsible for calling PA One Call (811) or arranging utility locates prior to the project start date if required.
Boulder Bound LLC reserves the right to suspend work during unsafe weather conditions, including but not limited to heavy rain, lightning, freezing temperatures, or high winds, without penalty.
Any changes to the agreed-upon scope of work requested by the Client after a contract or estimate has been signed must be made in writing and acknowledged by Boulder Bound LLC before the change is implemented.
Change orders may affect the total project cost and timeline. Additional costs resulting from approved change orders will be billed at standard rates and are due upon project completion unless otherwise agreed.
Boulder Bound LLC reserves the right to adjust pricing if site conditions discovered during excavation or construction materially differ from those present during the original estimate.
Boulder Bound LLC warrants that all work will be completed in a professional and workmanlike manner. Specific warranty terms will be outlined in your project contract.
The following are not covered under workmanship warranty:
Warranty claims must be submitted in writing to boulderboundllc@gmail.com and will be evaluated on a case-by-case basis. Boulder Bound LLC will make reasonable efforts to address valid warranty claims in a timely manner.
Material warranties are subject to the terms of the respective manufacturer and are passed through to the Client where applicable.
To the maximum extent permitted by applicable law, Boulder Bound LLC's total liability to the Client for any claim arising out of or related to services provided shall not exceed the total amount paid by the Client for the specific project giving rise to the claim.
Boulder Bound LLC shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of use, loss of income, or damage to landscaping not directly caused by our work.
Boulder Bound LLC carries general liability insurance. Proof of insurance is available upon request. The Client is responsible for maintaining adequate homeowner's or property insurance throughout the project.
Underground utilities: Boulder Bound LLC will call PA One Call (811) for public utility locates. We are not responsible for damage to private utilities (sprinkler systems, low-voltage lighting, private drainage, etc.) that are not disclosed or marked by the Client prior to excavation.
Excavation and construction work inherently results in temporary disruption to the surrounding property, including soil displacement, equipment tracks, and dust. Boulder Bound LLC will make reasonable efforts to minimize disruption and will clean up debris and excess materials upon project completion.
The Client acknowledges that:
Excess excavated material removed from the site becomes the property of Boulder Bound LLC unless otherwise agreed in the project contract.
In the event of a dispute, the parties agree to first attempt to resolve the matter through direct, good-faith communication. The Client should contact Boulder Bound LLC at boulderboundllc@gmail.com or (724) 766-9394 to discuss the concern.
If a resolution cannot be reached informally, the parties agree to pursue mediation before initiating legal proceedings. Any unresolved disputes shall be subject to binding arbitration under the rules of the American Arbitration Association, with proceedings conducted in Allegheny County, Pennsylvania.
Nothing in this section limits Boulder Bound LLC's right to pursue collection of unpaid balances through available legal remedies, including the filing of a mechanic's lien.
These Terms and Conditions and all services provided by Boulder Bound LLC are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict of law principles.
Any legal proceedings arising from these Terms shall be brought exclusively in the courts of Allegheny County, Pennsylvania.
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
